Relevant Forms for Road Adoption

Common Problems:
1. What types of construction shall be managed by Regulations Governing Air Pollution Prevention Equipment at Construction Sites?
A: Regulations Governing Air Pollution Prevention Equipment at Construction Sites are applicable to the construction projects which pay air pollution control fee according to the provisions of Air Pollution Control Act for more than NTD 2,000.

2. What is the punishment for violating Regulations Governing Air Pollution Prevention Equipment at Construction Sites?
A: For constructions violating Regulations Governing Air Pollution Prevention Equipment at Construction Sites, their faults would be recorded as demerits. TDEP’s auditors check construction sites infrequently. If more than 10 demerits are recorded in one audit, a fine of NTD 20,000 to NTD 200,000 would be applied per Article 56, Air Pollution Control Act; if the violator is an enterprise or a business site, a fine of NTD 100,000 to NTD 1,000,000 would be applied

3.If a construction violates Regulations Governing Air Pollution Prevention Equipment at Construction Sites due to special circumstances, how should they redeem?
A: If the construction owner cannot follow Regulations Governing Air Pollution Prevention Equipment at Construction Sites, he/she shall fill “Taipei City Construction Project Air Pollution Prevention Equipment Management Regulations Substitution Measure Application Form”. He/she shall explain why they cannot perform air pollution control regulations and the content of substitution measure, and submit to TDEP for reviewing. After passing the review, they can follow the substitute measure for air pollution control.

4. There are 11 items of pollution prevention measures for constructions in Regulations Governing Air Pollution Prevention Equipment at Construction Sites. Should they all be performed simultaneously while the construction is in progress?
A: Different types of construction would generate different pollutants in different stages. Regulations Governing Air Pollution Prevention Equipment at Construction Sites cover all types of possible pollution generated during construction and their required prevention measures. Thus, the pollution prevention measures in Regulations Governing Air Pollution Prevention Equipment at Construction Sites only have to be performed when the specific pollutant generated during the construction. If the construction doesn’t generate that pollutant, the corresponding pollution prevention measure doesn’t have to be performed.

5. In Regulations Governing Air Pollution Prevention Equipment at Construction Sites, some prevention measures cannot be performed alone. How can we distinguish which measure cannot be performed alone?
A: In Regulations Governing Air Pollution Prevention Equipment at Construction Sites, some prevention measures cannot be performed alone. They can be distinguished by the phrase “in coordination”. If there is the phrase “in coordination”, such as “in coordination with chemical stabilizer spraying”, that means the type of pollution cannot be controlled by only spraying chemical stabilizer.
