Subject: Revision of the “Area Coverage and Time Interval for Forbidding Peace Hindering Behaviors in Taipei City”, effective August 1, 2013.

Basis: Clause 4, Article 8 of the Noise Control Act

Contents:
I. The following behaviors are forbidden all day, in or within 50 meters of schools (of various levels), medical and health institutions (except clinics), or within educational districts in Taipei City (hereinafter referred to as the City):
(I) Discharging professional pyrotechnic devices or normal fireworks which give off whistling or explosive sounds; however, cultural activities or international exchanges which are approved by the City Government are not subject to this limit.
(II) Conducting temple (including altar) worshiping, fairs, marriage, funeral or other folk activities which involve the use of sound amplifying facilities.

II. The following behaviors are forbidden in all noise-controlled areas of the City between 10 PM and 8 AM.
(I) Discharging professional pyrotechnic devices or normal fireworks which give off whistling or explosive sounds; however, New Year’s Day, Chinese New Year Festival (the first day of lunar January), Lantern Festival, Dragon Boat Festival, Ghost Festival, Mid-autumn Festival, National Day, New Year’s Eve and other folk festivals recognized by the City Government, are not subject to this limit.
(II) Conducting temple (including altar) worshiping, fairs, marriage, funeral or other folk activities which involve the use of sound amplifying facilities.
(III) Engaging in outdoor assemblies, parades or other activities which involve the use of sound amplifying facilities; however, New Year’s Day, Chinese New Year Festival (the first day of lunar January), Lantern Festival, Dragon Boat Festival, Ghost Festival, Mid-autumn Festival, National Day, New Year’s Eve and other folk festivals recognized by the City Government, are not subject to this limit.

III. Use of non-business karaoke is forbidden in all noise-controlled areas of the City between 10 PM and 8 AM, and also on holidays: between 12 noon and 2 PM. Non-business karaoke refers to vocal accompaniment and audiovisual equipment provided for people to sing songs at places which are not permitted and registered business locations of the Audio-visual Singing Industry, or other non-business locations.

IV. Use of power machinery to carry out decoration engineering, which would hinder the peace in residence and apartment buildings, is forbidden within the noise-controlled areas of the City between 10 PM and 8 AM, and also on holidays: between 12 noon and 2 PM.

V. The following behaviors are forbidden in the first-class and second-class noise-controlled areas of the City between 10 PM and 8 AM:
(I) Catering, laundry, publishing or other commercial activities which involve the use of power machinery.
(II) Various commercial advertising behaviors which involve the use of sound amplifying facilities (including mobile commercial advertising vehicles).

VI. Use of power machinery to carry out construction work, which would hinder the peace in the first-class, second-class and third-class noise-controlled areas of the City, is forbidden between 10 PM and 8 AM, and also on holidays: between 12 noon and 2 PM. However, the following situations are not subject to this limit.
(I) Rescue and emergency repair engineering of damaged facilities which would endanger public security, pollute the environment and influence the water, power or gas supply or communication of the public.
(II) Safety measures assemblage of foundation piles (excluding percussive piling), diaphragm wall and underground structure engineering (including excavation work), mass concrete placing, large bridge hoisting and other continuous and necessary engineering which are approved by the industry’s competent authority.
(III) Construction in specially-controlled areas during the daytime (such as Bo’ai Special Zone, special service roads, etc.) which is approved by the industry’s competent authority.
(IV) Construction engineering for government-organized international or national important activities which is approved by case by the City Government.

VII. For the abovementioned Clauses VI (II) – (IV), the industry’s competent authority shall submit a copy of the approval documents to the Department of  Environmental Protection of the City, and the construction unit shall set up noise control facilities (including deadening fabric, anechoic chamber, anti-vibration pad, noise enclosure or other facilities with noise reduction function) at the construction site and erect night or noon construction billboards. Violators will be deemed to have breached the preceding terms.

VIII. The abovementioned night or noon construction billboard shall specify the name of the construction proprietor, night or noon construction approval document number, name of the construction unit, construction site director, construction site contact person and construction supervisor and their telephone numbers, as well as the City’s citizen hotline 1999.
